THE GUERRILLA ANGEL REPORT — After serving a stint as a community board chair, trans man Mel Wymore is running for a seat on the New York City council. He says he’s not doing this to make history, buy rather, because he wants to serve his community.

Wymore:  “After I served as chair of Community Board 7, I felt like City Council was a natural progression. I really enjoyed being chair of the board, . . . and being able to engage in so many different issues and constituents.”

On being trans: “I don’t know how else to be except open and honest about who I am.”

On being a trans role model: “I would hope to be a role model for all people, not just LGBT.  I hope I can stand as an example for anyone who wants to be empowered to participate in a bigger way.”

Trans rights bill repeal fails.

An attempt to repeal a recently enacted Baltimore county, Maryland trans rights bill has failed. Organizers failed to gain enough signatures and faced harsh opposition during public meetings as their scare tactics failed to drum up support for the repeal.

As a side note, it was reported that some of the people supporting the repeal were a small number of “radical lesbian separatist feminists”.

GOP-backed voter ID laws could disenfranchise 25,000 transgender voters

THE GUERRILLA ANGEL REPORT — You read that right, according to a new study, stricter voter ID laws enacted in states like Pennsylvania, Tennessee, Texas, and Wisconsin will put a large number of transgender voters at a major disadvantage where previously this hurdle did not exist.

Earlier I reported on the GOP’s agenda to get as many states as possible to place hurdles between voters and ballot boxes all in the name of preventing a non-existent problem – “voter fraud”. These hurdles impact Democrat voters far more than Republican voters. Now this new study confirms transgender voters will be impacted in a major way as well.

From the Williams Institute study The Potential Impact of Voter Identification Laws on Transgender Voters:  “. . . 41 percent of transgender citizens who have transitioned reported not having an updated driver’s license and 74 percent did not have an updated U.S. passport. Moreover, 27 percent of transgender citizens who have transitioned reported that they had no identity documents or records that list their current gender.”

Jody L. Herman, Ph.D., author of the study: “As lawmakers consider enacting stricter voter ID laws and contemplate their potential impact in the upcoming November elections, the consequences of these laws for transgender voters should not be overlooked.”

Clearly a large number of transgender voters will likely stay home rather than face a potential hassle at the polls. I’m thinking were looking at possible lawsuit or two . . . ACLU, interested?

Philly’s transit system’s “TransPass” discriminates against trans people

SEPTA - Embarrassing transgender people for 30 years!

THE GUERRILLA ANGEL REPORT – The pun is unintentional, but ironic. A trans person risks being laughed at by a SEPTA bus driver in front of passengers for having the “wrong” gender sticker on their monthly bus pass.

A group of transgender advocates in Philadelphia called RAGE (Riders Against Gender Exclusion) have been fighting the area’s transit system, SEPTA (Southeast Pennsylvania Transit Authority), over the gender stickers on the system’s monthly “TransPass” — a situation that clearly can cause embarrassment and confusion for trans people. Reports state some trans people were even prevented from boarding and ridiculed by drivers. SEPTA says the gender stickers are necessary to combat fraud — especially spouses sharing passes.

RAGE has collected signatures and staged protests since its founding in 2009 in an attempt to get the gender stickers off the TransPass. Recently however, founding member Max Ray stated that SEPTA general manager Joseph Casey will petition SEPTA’s authority board to remove the sticker requirement in 2013. This was reported in several news sources.

However, NBC 10 reported this: “A SEPTA spokesman told NBC10 the decision [to remove stickers] was unrelated to RAGE’s protest however. Instead he said it was made simply because there wasn’t a need for any stickers on the new preloaded card.”

Either way, the gender stickers are gone. But this story doesn’t end well for SEPTA. Thirty years of torture for trans people in Philadelphia and SEPTA didn’t yield an inch when it mattered and only to simply dismiss it away when new technology resolved the issue.

Thanks for nothing SEPTA.

[UPDATE] New LAPD trans policy includes respect, housing trans arrestees separately

THE GUERRILLA ANGEL REPORT — [UPDATE - Trans arrestees will be housed separately. See below.] Los Angeles Police Department Chief Charlie Beck announced a new policy for its officers to follow when dealing with the transgender community during stops and searches. The policy states officers are not to question the person’s expressed gender and cannot engage in questioning or frisking for the purpose of finding out their anatomical gender.

With minor offenses, trans people are allowed a bit of leeway in choosing gender of the officer handling them. When removal of prosthetics or wigs is required, the policy states the LAPD must handle trans people consistent with the requirements for handling non-transgender people.

Transgender Law Center’s Masen Davis: “This is a huge victory for transgender people who may interact with the police, and for transgender inmates.”

Knowing of trans people being harassed by police or first hand experience is something that many trans people have in common and with the LAPD joining a number of larger law enforcement agencies having such policies there may come a time when trans people may not fear interaction with the police.

UPDATE — April 12, 2012 From the LA Times:

The Los Angeles Police Department will begin housing arrested transgender men and women in a women’s jail by the end of the month, making it what administrators believe is the first police department in the country to do so.

The announcement came Thursday night from Capt. Dave Lindsay, commander of the department’s jail division, speaking to a meeting in Hollywood of transgender people with police Chief Charlie Beck and members of the city’s Police Commission.

Capt. David Lindsay said: “This is a major change that will allow for “an environment that’s safe and secure, as there’s been a history of violence against transgender people” in jail.”

Canada tries again with trans rights bill, Arizona goes off deep end

THE GUERRILLA ANGEL REPORT — Perhaps prompted by the Jenna Talackona-Miss Universe saga, Canada’s Parliament sped up a trans rights bill that was introduced last year with a second reading last week. The bill will add trans people to the Canadian Human Rights Act and make violence against them a hate crime. This is Canada’s fourth attempt at enacting a trans civil rights law.

The Arizona legislature this week sent three dubious bills to Gov. Jan Brewer to sign, one of which says that pregnancies begin 2 weeks before conception (date of a woman’s last period). Not only this makes a mockery of a woman’s biology, it is also a legal Pandora’s Box that will make a beeline to the U.S. Supreme Court. Another bill requires that schools teach kids that for unwanted pregnancy, adoption and birth is the most acceptable outcome. A third bill prevents doctors from being sued if they don’t tell parents something about the fetus that might cause them to terminate the pregnancy.

I won’t begin to get into this shameless runaround of a woman’s right to make choices. But I will once again stress that it is the President of the United States who appoints justices to the U.S. Supreme Court – the final arbitrator of nutty laws like these. Please vote accordingly.

Federal judge says trans woman’s health insurer flagrantly violated its duty to the insured

THE GUERRILLA ANGEL REPORT — Christine Radtke legally transitioned to a female several years prior to her marriage to her husband Calvin Radtke. After their marriage, the couple enrolled in Calvin’s employer’s health plan. Somewhere along the line, the administrators of the health plan discovered that Christine underwent sex reassignment surgery (SRS) in the past and decided that their marriage did not conform to Minnesota law. They cancelled her coverage and demanded a retroactive repayment of $80,000.

The couple sued and the insurers counter-sued claiming Christine fraudulently represented being a woman. Recently however, a judge ruled for Radtke and gave the insurers a bit of a scolding.

U.S. District Court Judge Michael Davis said that, under Minnesota law, a married individual’s sex is determined at the time he or she is married. In his opinion, Davis wrote that the health fund had “ignored all evidence” concerning Minnesota law about the issue, and said its treatment of the plaintiff “was a flagrant violation of its duty under any standard of review.” – From The New American.

More from Judge Davis: “There is no law in Minnesota that prohibits recognition by the state of a person’s changed sex. Minnesota is among 43 jurisdictions, including Wisconsin, that permit individuals who have undergone sex reassignment surgery to change their birth records to recognize change of sex.”

Some are noting that this ruling is going against a trend to invalidate marriages when it comes to transgender health benefits — the Texas firefighter case comes to mind. However, I am not sure the people commenting on this “trend” are in a position to know the specifics in the cases involved and are able to accurately state the facts.

This is a good win and nice legal precedent for trans people.

As for the source, keep in mind it’s somewhat biased against trans people and naturally all gender references are incorrect and I’m pretty sure they’re not all happy with Judge Davis’ ruling.

Judge tells NYC health dept. to loosen up on transgender birth certificate case

THE GUERRILLA ANGEL REPORT — A 70-year-old trans man had sex reassignment surgery (SRS) but the New York City Health Department was giving him the runaround when it came to changing his birth certificate. So Louis Birney took them to court. In a ruling, state Supreme Court Justice Paul G. Feinman agreed with Birney and gave the city a scolding:

From the Associated Press: [Feinman's] ruling faulted the Health Department for not providing “a clear, straightforward list” of requirements for changing a birth certificate. And he suggested that calling for psychological records amounted to overreaching for information and underappreciating what it takes to change genders.”It does not seem very likely that an individual would go through all the years of required preparation for surgical transition, including psychotherapy, undergo major surgery, assume life under his or her new gender, and then decide it was all a mistake and change back,” Feinman wrote. “This apparent assumption tends to suggest a certain ignorance by the department of the lengthy transition process and the lives and experience of transgender people.”

Erica Kagan, Birney’s lawyer: “I hope that the Department of Health will really take this to heart and really see that the court is, in this decision, recognizing the importance of respecting the identities of transgender individuals.”

While it is not quite clear what the city is going to do in reaction to the ruling, but changes are expected. Trans advocates in NYC are also hoping the city eventually drops the surgery requirement as well.

THE GUERRILLA ANGEL REPORT — The election is over and the Anchorage trans-LGB rights bill failed, however I feel the need to share this bit of information I discovered only after the election.

Opponents of  Anchorage’s Proposition 5, ran a series of cartoons dehumanizing trans people on television in an attempt to use fear to sway voters. Here’s an example:

From On Top Magazine: In the 30-second ad titled Daycare and released on Friday, an animated day care owner is forced to hire a “transvestite” as horrified parents look on. The cartoon “transvestite” is drawn to look like an unshaven, hairy chested man in a short pink dress. “If she hires him, she risks losing customers,” a female narrator is heard saying. “And if she refuses, she can be fined or imprisoned. Anchorage is already a tolerant city, vote no on Proposition 5,” she adds.

Jim Minnery, Chair of the No on 5 Campaign: Because proponents of Prop. 5 refused to provide a definition of  “transgendered identity” in their proposed law, it is very difficult to  determine just what a transgendered individual is or looks like.

Transgender woman killed in Detroit, Anchorage voters reject transgender-LGB rights initiative

THE GUERRILLA ANGEL REPORT — Details are scant on the killing of trans woman Coko Williams. She was found shot to death outside a home in the Parkhurst area of Detroit on April 3, 2012. No other facts available at this time.

Voters in Anchorage, Alaska have apparently rejected the trans-LGB legal protection initiative. Strong vocal support for and against this measure attracted the attention of people outside of the city and the state of Alaska. On election day, matters were further stressed when a number of polling places ran out of ballots and misinformation from opponents of the bill confused some voters, although most likely those confused were against the ordinance.

While the ACLU is looking into the matter, it doesn’t appear there are enough ballots in question to change the outcome. Proponents of the initiative say it’s just a matter of time before an ordinance like this becomes law.

I should note here that opponents of the bill portrayed trans people in demeaning cartoons to drum up opposition to the bill.

Conservative Supreme Court justices hands transgender people a serious invasion of their personal privacy

On election day, remember to vote accordingly.

THE GUERRILLA ANGEL REPORT — A divided U.S. Supreme Court with swing voting Justice Kennedy joining the 4 conservatives ruled that jailers can subject people arrested for minor offenses (such as traffic stops) can be subject to invasive strip searches.

I do not need to explain the tremendous negative impact this will have on trans people, especially those that are transiting. Now its open season if you get busted for a minor traffic offense and taken to jail. Backward thinking jailers in backward thinking counties and states may do who-knows-what.

Prior to this ruling, lower courts tended to ruled that invasive strip searches were not permitted for minor offenses. Indeed, a number of states had laws against it. But it has all been overturned by 5 conservative Supreme Court justices — all appointed by Republican presidents. The 4 liberal justices who opposed the ruling were appointed by Democrats.

Who you vote for MATTERS. The Supreme Court is the final arbitrator of the constitutionality of laws, ESPECIALLY nutty laws, of which many have been passed these days.

For trans people, showing up on election day and voting for the president who will appoint justices that has your well-being in mind is the single most important decision you can make for yourself.

25-year-old Chinese twin sisters to become twin brothers after SRS

THE GUERRILLA ANGEL REPORT — How’s that for a twist? One sister underwent her sex reassignment surgery (SRS)  in a Shanghai, China hospital a few days ago while the other had her SRS a few months ago. The surgeon,  Zhao Yede,  says the surgery was successful and they would later return to complete the final surgical phase. According to the Chinese newspaper, only after the last step can they legally apply for a change in the Chinese gender-swap registry, but until then, they’re still considered females.

The twins are keeping their identities a secret for now because they need their jobs to fund the last part of their sex reassignment. They’re also concerned of pressure from family and friends before the process is complete.

The twins learned online of the availability of SRS in China only a year ago and quickly took steps to correct a difference they both were aware of since kindergarten.

Killer of trans man Brandon Teena denied appeal by the U.S. Supreme Court

THE GUERRILLA ANGEL REPORT — The violent death of Brandon Teena in 1993 helped trigger the adaptation of hate-crime laws for transgender people in the United States and the eventual making of the film “Boys Don’t Cry” landing the actor portraying Brandon, Hilary Swank, an Oscar.

One of Teena’s killers, John Lotter, sits on death row in Nebraska. He has however, been appealing the conviction, reaching all the way up to the U. S. Supreme Court. Last week, the court denied the request without comment. While Lotter can ask the court for one last rehearing, it does appear he will remain convicted of the murders of Teena and two witnesses.

Esteemed trans advocate Alexis Rivera dies from health complications

THE GUERRILLA ANGEL REPORT — Most recently as policy advocate for the Transgender Law Center providing leadership training for trans people in California, Alexis Rivera advocated for over a decade in the area of health care for trans people and trans equality. Her numerous awards and honors serves as a testament to her accomplishments and inspiration for the rest of us.

Rivera died on March 28, 2012 in San Francisco at age 34 from illnesses related to HIV.

Transgender Law Center’s Masen Davis: “She understood that we are stronger together, and she kept organizing until the very end. Alexis’ death is a reminder that the fight for equality — and against AIDS — is far from over.”

I noticed one news report referred to Rivera as a pioneer in the area of trans rights. I agree with this. She was young, but the era of trans people having the things she fought for is young too. Her place in transgender history is assured of being prominent.

THE GUERRILLA ANGEL REPORT — Charles Barkley, the former NBA star, sports commentator and now, Weight Watchers spokesperson, posed in drag for the upcoming Weight Watchers campaign to get men on board with losing weight.

Now, this may or may not cause a ruckus with some, but Barkley, who has been known to perform in drag in the past, might be doing us a favor by helping reduce some of the negative stigma some people in society have against those who do not conform to their rigid set of beliefs. Barkley, after all, is the kind a guy many of those same people would gladly have a beer with.

It’ll be interesting to see how this new Weight Watchers campaign plays out — does it open a few minds while getting the attention of those in need of a weight loss program or does it backfire and causes heads to roll at the advertising firm that thought up this promotion?

[UPDATE - Suspect arrested] Trans prostitute killed in Riviera Beach, Florida

Tyrell Jackson killed by armed robber targeting prostitutes.

THE GUERRILLA ANGEL REPORT — [UPDATE -  Suspect arrested, see below.] The only thing we do know for sure is this person was a prostitute and died after being shot. The Orlando Sentinel says the victim is a transvestite prostitute named Tyrell Jackson. The Palm Beach Post called Jackson a transsexual prostitute and referred to Jackson as a man.

All reports do agree that there was a string of armed robberies targeting “t” prostitutes around the same time and Jackson was the only one killed. Another person with Jackson at the time was injured but was expected to survive.

Riviera Beach police spokeswoman Rose Anne Brown: “This suspect has targeted young men who are living a life as transsexual prostitutes.”

Jackson’s mother Wanda Chavers: “He was my only son and I just loved him so much. He was a lovely person. Everybody loved Tyrell and I’m going to miss him.” Jackson’s sister Takesia Jackson did disclose that her brother was gay.

This is a tragedy, no doubt, but is it a transgender killing? I’ll let the readers sort it out.

UPDATE: April 8, 2012 – From WPBF: Police have arrested a man suspected of targeting transsexual prostitutes. Riviera Beach police said Luis De Los Santos was arrested Thursday in connection with last month’s double shooting that killed a man and injured another. . . Police said De Los Santos was driving a silver 2003 Buick Rendezvous when he was pulled over during a routine traffic stop. Police said it was the same vehicle the shooter was believed to have been driving.

“When someone has put it in their mind to perhaps target individuals because of the way that they live their lifestyle, not only is that interfering with their safety, that’s interfering with their personal freedoms,” Riviera Beach police spokeswoman Rose Anne Brown said.
