[UPDATE] Anti-LGBT Rights Governor to Speak at Prominent Deaf Civil Rights Group’s National Conference

I’m having a hard time figuring out the logic behind the decision making here. In the first place, the National Association of the Deaf (NAD) has existed since 1880, filling a dire need to ensure deaf people were afforded the same equal rights as hearing people. Indeed, the oppression of deaf people is a shameful chapter in America’s history and the NAD was at the forefront all this time fighting for equality and access for all deaf people.

It was a rather stunning surprise when I discovered the NAD scheduled South Dakota’s Republican Governor Dennis Daugaard as one of the primary speakers at its national conference being held this summer. It is no surprise to anyone that Gov. Daugaard opposes gay marriage and has stated that no individual groups should be given special privileges. Gov. Daugaard is allowed his views and since he was duly elected by the people of South Dakota, I’m not going to second guess their decision. But it is fairly clear that Daugaard’s view doesn’t belong at the NAD conference.

So why was he invited? It’s because he can sign. He comes from a deaf family. Although for reasons that make no sense to me, many in the deaf community hold (adult) hearing children of deaf parents in high regard — enough so, they’ll seeming toss aside their understanding of the meaning of the word “equality.”

In social media, the large deaf LGBT community is in an uproar. A website used by the community to follow the matter had previously collapsed under the traffic load, but I did manage to get a working link to another site which includes a decent summary of their position:

Why should NAD members care about Daugaard’s position on same sex marriage? Because the NAD’s invitation and response leaves us with some damning messages. Daugaard voted for the constitutional amendment in 2006 that defined marriage in South Dakota as being between one man and one woman. In other words, he supports legal discrimination against a minority group. This is a denial of equal access to citizenship and its privileges.

I must caution some in this group who are attempting to tie Gov. Daugaard to the closing of the school for the deaf in that state. That was an economic matter and he was not even governor at the time. Rumors of this type can backfire. Then there are a few who hurt their own causes by excluding non-deaf people from access to the information supporting their own claims.

At this moment the NAD is seemingly trying to appease the opposition to Daugaard by addition of a LGBT luncheon to the conference and the announcement of a new LGBT equality policy.

My feeling is the NAD is misjudging the strength of the overall LGBT movement in America. They should cut their losses and heed the call to replace Daugaard. There are plenty of prominent people in America that can sign; some are even LGBT advocates.

Larry Berke, Lisa Goetz and other convicted VRS fraud thugs head to jail or house arrest

Larry Berke sent to prison, Lisa Goetz and Donald Tropp sentenced to house arrest for defrauding the federal government.

THE GUERRILLA ANGEL REPORT — A number of people were sentenced in the past few months following their conviction of involvement in a widespread scheme to defraud the federal government. Deaf video relay businesses owned and run by deaf and hearing people deliberately over billed the FCC for relay calls they did not make or made fraudulently.

The FCC set aside money for video relay services (VRS) to provide video interpreting services for deaf callers needing to phone hearing people. These thugs tapped into that loosely regulated pot of taxpayer money and drained it of upwards of $50 million dollars. As a result of this greed, the VRS program is perhaps jeopardized. The final fallout from this has yet to occur.

At this point, half of the 25-odd people involved have been sentenced with others still awaiting court sentencing decisions and/or trials. It is also possible more people will be charged at a later date.

In a previous post, I reported that the likely Father of the VRS fraud scheme, John Yeh, was sent away for 9 plus years and was required to payback $20 million of the amount he stole. His brother Joseph got about 4 years and was also given a $20 million dollar tab.

This time around the top dog is Larry Berke. He was sentenced to 2 years in prison, 3 years probation and $2.5 million repay. Berke’s apparent new wife, Lisa Goetz, 5 years probation with one year of house arrest and $2.5 repay. Donald Tropp also got 5 years probation with one year of house arrest and $2.5 million repay.

Kim E. Hawkins, Jessica Bacallao, and Wanda Hutchinson all received a similar sentence as Tropp. Nathan Zfati, Tamara Frankel, and David Simmons all received varying degrees of lessor sentences. All charges against Kathleen Valle were dropped.

In related news, it has been reported that a marriage license was applied for by Larry Berke and Lisa J Goetz in Yavapai County (AZ) Superior Court in December, 2011. Other evidence suggest a wedding has occurred since that time.

The Deaf community’s final meltdown? (Deaf babies, sign language (ASL), cochlear implants and deaf education)

THE GUERRILLA ANGEL REPORT – While the war on deaf education – Oralism vs. Sign Language (ASL) – is as old as, well, the telephone, the bickering continues. New technology – Cochlear Implants (CIs) seems to favor oral methods, yet the CI is used by the signing deaf too. Although words such as “genocide” and “culture” is thrown around, both parties still exist.

In recent years however, support for signing in deaf education has seen erosion — not necessarily as a result of Alexander Graham Bell’s superior oral firepower or the Cochlear Implant’s tendency to render sign language interpreters obsolete, but rather, the realization of the actual cost to society to fund a community dependent on sign language, and more importantly, the lack of evidence showing the hundreds of millions of dollars spent yearly on deaf education (residential deaf schools and Gallaudet University) is one iota better than not spending the money at all (mainstreaming all the kids instead).

Then there is the cloud of greed hanging over the signing deaf community as a result of multiple convictions of top deaf community leaders for defrauding the federal government (perhaps totalling over $100 million when all is said and done). The icing on the cake here is the Gallaudet Board of Trustees awarding the college’s retiring president the status of being the highest paid retired federal employee.

The following is a discussion from a deaf education usergroup that I found particularly worth sharing because it offers insight into minds of many in the deaf community AND is one of the rare “discussions” that isn’t akin to preaching to a choir — rational thinking enters this discussion, hence its usefulness in sharing here:

Only one party of this discussion has “technically” given approval for their name to be used so I will refer to the other parties as “Person A” and “Person B”.

From a discussion titled:  “Re-examining the Influence of Auditory-Oral Education Movement on the Deaf Community in Politically Turbulent Times”

Person A [a professor at Gallaudet University]: Why this obsession with creating troops of robobabies [deaf kids who have the Cochlear Implant] when many of them, like oralists before them, will still gravitate to sign language anyway?

Joseph Pietro Riolo: I am not going to suppress your freedom of expression.  But, the freedom of expression is not without consequence.

Calling the babies with cochlear implant as “robobabies” is not really a nice way of labeling them.  Some of them will grow up and become very involved in the deaf community.  Some of them will become advocates.  Some of them will work in Gallaudet University, RIT[Rochester Inst of Technology]/NTID, CSUN[Calif. State Univ. Northridge], deaf schools and deaf programs.  Maybe, one of them would be your boss.  Maybe, one of them could become a president of Gallaudet University. Maybe, one of them could be a student in your class.  Just imagine when they happen to meet you and later on, learn that you called them as robobabies when they were babies. I truly hope that they will hold no grudge against you and be very forgivable but they may think twice when they think of you.

Enough preaching from pulpit.

FDA lowered the approved age for cochlear implant to two years old in 1990, 18 months old in 1998 and one year old in 2000.  Right now in this year of 2012, those who received cochlear implant when they were two years old during 1990-1998 cannot be older than 24 years old.  Those who received cochlear implant when they were 18 months old during 1998-2000 cannot be older than 15 and half years old.  Those who received cochlear implant when they were one year old since 2000 cannot be older than 13 years old.  What this means is that the deaf college students with cochlear implant that we see at the colleges received cochlear implant no earlier than when they were two years old. Those who received cochlear implant when they were one year old have not reached colleges yet. 

I absolutely have no idea how many of them will gravitate, as you put it, to sign language.  I came across a comment saying that these children who received cochlear implant at one year old are the new wave that is going to affect everything from Gallaudet University down to programs and services for deaf babies.  The new wave will not hit Gallaudet University, RIT/NTID and CSUN until around 2017 (or maybe 2016).

Person A:  Perhaps we shud ask the GAO and the DOE to do a joint study of the costs beginning with costs of implants, speech and hearing therapy costs, training parents, counseling them etc vs costs of raising a deaf child in a signing environment.

Riolo: I don’t mind the study.  But, I have the fear about it.

What if – I have to emphasize the key word “if” – the study really show that educating a deaf child in a signing environment costs more than educating a deaf child with bilateral cochlear implants in an oral environment. If – again, the key word “if” – it really happens, I cannot imagine how destructive this study will be for the parents who choose to raise their deaf children without cochlear implant and for the deaf schools and programs that offer
signing environment.

My fear is not completely unfounded.  In my state, there are several private schools that are approved by the state of Pennsylvania to receive funding for the deaf students. [privacy contents deleted] The following information comes from the directory file whose link is available at:

Western Pennsylvania School for the Deaf (WPSD)
$63,794.00
$100,882.00 (5-day residential)

I know for sure that PSD and WPSD use signing environment and that DePaul school uses auditory-oral environment.  I don’t know about two other schools.

Using DePaul’s cost as the base, PSD’s cost per student is 1.19 times DePaul’s cost.  WPSD’s cost per day student is 1.45 times DePaul’s cost.  From this information alone without any context and qualifications, it is not hard to predict that the cost of raising a day deaf student in an auditory-oral environment will be lower than a signing environment.

We should be careful in calling for the study on the costs.  As the saying goes, be careful for what you wish.

Regardless of which way the study will go, we cannot use the cost as the rationale for justifying one approach over other approach. We need to use a different framework or paradigm.  We need to appeal to the moral, religious and/or ethical values.  We need to use these values to justify any approach, leaving the decision right in the hands of parents.  If parents do not want their deaf children to have cochlear implant and want to raise them
in signing environment, the educational programs have the moral and ethical duties to support these parents’ decision.  Likewise, if parents truly want their deaf children to receive bilateral cochlear implants and want to raise them in auditory-oral environment, the educational programs have the moral and ethical duties to support these parents’ decision  Likewise for any decisions between these two ends of the spectrum.  The cost should not be used to favor one or some approaches over other approaches.

Person B [Unidentified]: We need to display research showing their statements [the superiority of Cochlear Implants over sign language] are false and support with research like below definitely pointing to the fact that those with CI are not doing any better than Deaf Children without CIs. Here is one such example:

“Dr. Marc Marschark wrote this: “…. Certainly, kids with implants are doing better on average than kids without implants, but they still generally perform behind hearing peers. …” [Quoted from http://www.rit.edu/ntid/educatingdeafchildren/?p=683 ]

Riolo: The key words in the quotation are “on average”, meaning that there are some kids with CI doing worse than kids without CI and some kids with CI doing better than kids without CI.  When hearing parents read the above quotation by going to that website and then, read what you wrote, they will ask themselves who is telling the truth.  What will they do?  One of the possible ways that they will do is to examine your credibility and Dr. Marschark’s credibility and decide who to trust.

From reading your post, it is obvious that you have your own ideology.  There is nothing wrong with it.  There is no crime in having an ideology.  But, what you seem to overlook or won’t admit is the hard, real fact that the auditory-oral education really works for some deaf children. This fact alone is enough to grab the attention of the hearing parents.  It will be extremely hard but not impossible to redirect their attention to ASL or any sign language or signing system.

Pulpmovies Film Review: “Lexie Cannes.” 4 Stars (out of 5)

A woman who cannot hear is stalked.

Country: USA, Released: 2009 Running Time: 71 minutes Drama, Thriller

The synopsis I saw for Lexie Cannes presents the film as a thriller in which the eponymous heroine finds herself stalked by two men, one relatively harmless, the other much less so. This description is accurate as far as it goes, but it does undersell a film that has a much broader scope than this.

More a drama than a thriller, the film is primarily a study of the character of Lexie Cannes herself, and what a character she is. Lexie is a deaf, transsexual woman building a life for herself as a photographer in Oregon. She has some relationship problems, a broadening circle of friends, a desire to put her past behind her and a strong urge to help when she encounters people in trouble. There are many layers to her personality but what shines through most strongly is Lexie’s essential humanity. While her specific circumstances will be unfamiliar to most, the core tale of someone coming to terms with their past so they can build a future is one with which anyone can empathise.

It is to the credit of writer/director, Tom Bertling that he has managed to develop a character that faces such a specific set of circumstances in a manner that feels almost familiar to a general audience. Lexie Cannes is a complex, fascinating and very well rounded character and she is superbly brought to life by Courtney O’Donnell who, in the title role, does a great job of capturing the complexity of the character.

While the plot can feel a bit episodic in places, this is more than made up for by both the strength of the performances and the atmosphere the film achieves. Logically, for a film about a deaf person, there is no natural sound. What we have instead is a soundtrack that plays for the entirety of the film and which does an incredibly good job of capturing the mood of both the characters and the events in which they find themselves. Although there is some (signed) dialogue, this is essentially a silent film and one that demonstrates just how powerful this type of film can be.

Visually, the film is something unique. Much of it is shot at night and often viewed through a camera or camcorder lens and giving the film a grainy feel that effectively adds an air of uncertainty to otherwise familiar settings. This is especially effective when dealing with the stalker part of the plot.

Lexie Cannes is a very real and very compelling portrait of a woman determined to surmount the obstacles she finds before her and build a life with which she can be both comfortable and happy. The performances are strong throughout and these, combined with a strongly atmospheric soundtrack and visual style, make for a film that is a powerful and moving experience.”

University of Washington Perspectives: Seattle Deaf Film Festival Comes to UW

UW’s ASL and Deaf Studies Program’s Lance Forshay: “Our program aims to create awareness of deaf culture, this festival is an opportunity to do that . . .

Audiences can expect to see films created by, for, or about the deaf community, in genres ranging from documentary to drama to comedy to animation.”

UW’s Computer Science and Engineering staffer Rob Roth is on the film selection committee: “We’re considering the deaf culture aspect of the film—the use of deaf actors, a deaf storyline—but also looking at technical aspects and the quality of the script, taking into account what would interest audiences.”

VRS fraud felon Jessica Bacallao using her parents’ deafness to escape jail term

THE GUERRILLA ANGEL REPORT — Newly disclosed court documents show that the attorneys for federal fraud felon Jessica Bacallao are attempting to use her parents’ deafness as an excuse to avoid a jail term for her crime.

Bacallao is currently awaiting sentencing from a federal judge which is believed to occur in the middle of March for her part in defrauding the Federal Communication Commission’s video relay program.

A number of people have been convicted thus far for VRS (video relay service) fraud, others are in pretrial or awaiting sentencing. Two such convictions resulted in the payback of $20 million dollars each and jail terms of up to nearly a decade.

What is unique in the Bacallao sentencing case is that she is claiming she is needed by her deaf parents, primarily as their interpreter and a jail term – guidelines suggest 4 years plus – would put undue burden on them.

This is pure baloney. Deaf parents are perfectly able to function in society without relying on their adult children to be present every day for interpreting needs. Secondly, the Americans With Disabilities Act requires that business and service providers either provide their own interpreters or provide other means of communication for people who are deaf.

These documents are intended to help the judge decide on a sentencing and I hope he is able to see through this baloney that deaf people are unable to function without their adult kids providing interpretation needs.

Sorry Jessica, if you do the crime, you have to do the time. Mom and Dad will be just fine.

Ex-prez of a small college (Gallaudet U. for the deaf) is highest-paid federal retiree!

THE GUERRILLA ANGEL REPORT — Not the former vice president who served for decades in public service, not former House Speaker Newt Gingrich, nor a doctor or administrator of a federal agency, but rather, I. King Jordan, the retired president of a small college that is wholly funded by the federal government.

Gallaudet University in Washington D.C.  serves deaf students. It receives $120 million dollars of taxpayer money each year while its drop-out rate is among the worst of all brick and mortar colleges. Towards the end of the school year the Gallaudet undergraduate student total is usually a couple hundred kids under 1,000. Indeed, the enrollment rate, graduation rate and retention rate has reportedly been in a free fall since the 1990s. To top it off, the educational outcomes have historically been woefully poor, especially in the area of English literacy. Deaf students no longer are restricted to this one college — for decades, deaf students have thrived at programs located elsewhere around the country.

Upon Jordan’s retirement a few years back, the Gallaudet Board of Trustees, having very little accountability to the taxpayers funding the school, deemed Jordan worthy of the highest federal retirement package in the nation — $375,900, per year.

Media requests for comments from Dr. Jordan were ignored.

Those within the deaf community say talking about the retirement pay issue amounts to “bickering.” Some Gallaudet faculty members have made inane arguments like ‘NBA players get paid more’  to stop debates — completely forgetting that taxpayers  pay Jordan’s retirement and their own salaries. This suggests many live in a bubble of EXPECTATION of federal support — not the demonstrating of DESERVING  federal support.

This expectation has manifested itself elsewhere — including the defrauding of the federal government by video relay services — many, if not most of the 26+ and counting indicted people have ties to Gallaudet. Indeed, many of the ringleaders have ties to one particular fraternity on the D.C. campus.

There is a juicy story here worthy of investigation by the Washington Post.

Back to Jordan. Excessive, irresponsible and maddening as some say? I have to agree. Dr. Jordan, do the right thing – cut your retirement benefit to $150,000 a year and return the rest to the U.S Treasury and become a man of great respect!

[UPDATED] Fraudulent deaf video relay providers Viable, Bonheyo & Bonheyo — a quick look back when the story first broke

Now convicted of fraud, these Viable executives caused chaos for the deaf business community.

THE GUERRILLA ANGEL REPORT — [UPDATED Jan 27, 2012 -- Both Bonheyos arraigned in federal court -- see below.] With the Viable executives headed to jail and the Bonheyo & Bonheyo executives now indicted, I reviewed a number of  deaf issues/news websites to get a gist of what was happening when the VRS  (video relay service) scandal broke.  Some of the anonymous sites were pretty nasty towards Viable executives John Yeh and Anthony Mowl — mostly containing mostly hearsay that I cannot confirm (I shall not link to them). But common to a number of them read something like this:

(from the CBS News comments section) “by [deleted] December 1, 2009 9:20 AM EST: What about Bonheyo and Bonheyo LLC (Bridget and Jerry Bonheyo)and [deleted]? They hired employees to make illegtitmate calls. FCC should do an investitgation on them!”

It appears that fraud among VRS was common knowledge even back then. Other video relay service providers were named as well. Whether or not any other VRS providers will be indicted by the Justice department is anyone’s guess. But it would be no surprise that the Justice department is working from clues served up on a plate at these websites.

Then there were some like this one (also from the CBS News website):

“by mary moylan November 19, 2009 11:05 PM EST I am a certified (CI, CT and SC:L written) sign language interpreter. I worked for Viable Communications at the Ellicott City location. I was trained as a video relay interpreter by a different company who taught us FCC rules. Although I repeatedly told my manager that the calls were NOT legit, she said John Yeh (the president of Viable) told us to “go ahead and interpret.” I refused. I was illegally videotaped by Viable hanging up on “phony” calls. Although I have been an interpreter for 22 years, I have been banned as a “bad” interpreter (by the deaf community as well as interpreting agencies) for suing Viable because I am still owed 2 paychecks by the company. My lawsuit was thrown out of court because John Yeh has multiple shell companies and I am unable to pierce the corporate veil. By his criminal activity, he has destroyed countless interpreters’ lives. No one seems to care about how we, the interpreters, have been negatively affected.”

I did a background check and confirmed that Ms. Moylan is indeed an interpreter and former Viable employee. And she did attempt to recover money through the courts. Also, her case is discussed on some interpreter websites. I do not know what ultimately happened to Ms. Moyland, whether or not she ever received her pay or even if she is still a sign language interpreter.

In the two years since the first indictment, the reputation of deaf businesses took a severe hit. The final tally of the damage to the community caused by widespread personal greed won’t be totaled up for years. The number of people indicted for VRS fraud runs into the dozens. Whitewashing and excusing criminal behavior is not the path toward rebuilding — sadly, this is exactly what some are doing. Hopefully, old values are toss aside to rid the community of those who believe taxpayer money is theirs for the taking, stolen or not.

UPDATE-1: Jan 27, 2012 — Both Bridget and Jerome Bonheyo were arraigned the Trenton, New Jersey federal district court.  Both pleaded not guilty. Trial is scheduled for March 2, 2012.

There is not much additional information at this, however, my hunch is that if a plea bargain isn’t reached with the parties shortly, we’ll see a continuance of the trial until some time later this year because we’re looking at only 5 weeks between the arraignment and trial date. I’ll keep you posted.

[UPDATE-2] Bridget Bonheyo and husband indicted in another VRS (video relay service for deaf people) federal fraud case

VRS provider CEO Bridget Bonheyo and her husband Jerome Bonheyo both indicted on federal fraud charges.

THE GUERRILLA ANGEL REPORT — [UPDATE-2: Jan. 27, 2012 -- Bonheyos arraigned in federal district court.  See below.] Just two weeks ago a federal judge sentenced John Yeh, the CEO of a video relay company to 9 years in jail and must repay $20 million dollars for defrauding the federal government. Now there’s a report of executives of another company being indicted on similar charges — forcing (or willingly allowing) employees to run up bogus charges in order to defraud the federal government. The indicted executives supposedly appeared in Maryland federal district court Monday Dec. 15, 2011. The report also says the case has since been transferred to New Jersey district court.

UPDATE-1: Dec. 26, 2011. The executives indicted are Bridget Bonheyo and Jerome Bonheyo, owners of Bonheyo & Bonheyo LLC. Case 3:11-cr-00861-JAP. Seven counts each. Somewhat disturbing is that several years ago when the Yeh/Viable case first surfaced, people posted on deaf forums stating other video relay companies were doing the same thing, and the Bonheyos were mentioned by name as an example. This could mean the practice of defrauding the federal government could be as widespread as the rumors then indicated. The Bonheyos apparently closed down their business after John Yeh’s arrest and word is “evidence” was purposely destroyed. Obviously we will be finding more facts about this case as time goes on.

Another disturbing trend is the “excusing” of this by some in the deaf community. Some in the community feel that the money should have gone to deaf people to “support” them anyway, even if it was taken fraudulently! There’s also the whitewashing of the seriousness of the crimes — “good people” do not steal $20 million dollars and get sent up to prison for a decade. The deaf community ought to own up to having thugs in their midst and use this as lesson as a means to set people on the right path.

A video relay provider translates a deaf caller’s signing into voice so that they can communicate with hearing people by phone. The federal government provides a lot of the funding. These companies defraud the government by running up charges for calls never made, or calls to their own employees.

Deaf patron of the arts and esteemed community leader sentenced to nearly a decade in jail

John TC Yeh, former Gallaudet University trustee convicted of fraud.

THE GUERRILLA ANGEL REPORT — In addition to the prison term, John Yeh was ordered to pay $20 million in restitution. Mr. Yeh is the former CEO of deaf services business Viable. He was convicted of conspiring to defraud the Federal Communications Commission’s Video Relay Service program. Mr. Yeh and his firm charged the federal government for illegitimate calls. He was sentenced by federal Judge Joel A. Pisano of the U.S. District court in Trenton, N.J.

Viable vice president Joseph Yeh, John Yeh’s brother, was sentenced to 55 months also order to pay $20 million in restitution.  Other Viable executives, Anthony Mowl and Donald Tropp,  are scheduled to be sentenced later this month.

Mr. Yeh, was a trustee of Gallaudet University and has received many honors, including Deaf Person of the Year. He has also started a number of very successful businesses. He was well liked and gave back to the community generously.

I’ve been giving Mr. Yeh the benefit of the doubt until now. It is quite clear that that anyone of Mr. Yeh’s caliber — university trustee, business owner — knew exactly what his company was doing the entire time they were defrauding American taxpayers. Mr. Yeh has fallen from grace and now, along with his gang of thugs, has a debt to pay society. Let’s not make excuses for the convict until his debt is paid off, then we’ll talk.
