Sen. Al Franken fights for transgender, LGBT workplace rights

senator-al-frankenTHE GUERRILLA ANGEL REPORT — Al Franken, the U.S. Senator from Minnesota says that it’s insane that workplace discrimination against trans people isn’t illegal and is something that should have been done about it long ago.

Franken points out that in a dozen states it is actually legal to fire someone because they are trans or LGBT. Contrast this with current laws that prevents discrimination against employees involving race, gender, or disabilities. Franken argues ‘why should it be legal for gender identity (or gender expression) and sexual orientation be cause for someone losing their job?

Franken has taken a very public and visible stand on the matter even though the state he represents already has a trans and LGBT workplace rights law on the books. Sen. Franken believes such a law should be extended for all 50 states.

Sen. Franken, of course, is a best selling author, comedian, and former writer for Saturday Night Live. He is also one of the smartest men in the U.S. Senate.

Michigan politician wants signs to warn people of ‘bathroom confrontations by men who think they are women’

THE GUERRILLA ANGEL REPORT — While city commissioners in Royal Oaks, Michigan work on ways to get a transgender and LGBT anti-discrimination ordinance enacted into law, a Michigan state representative voiced his opposition by saying that at the very least, a requirement of warning signs be placed on bathroom doors to warn women and children of ‘men who think they are women’.

Michigan state House Rep. Tom McMillin:

“At the very least, the council should have also included a requirement for warning signs on women’s and girl’s public restroom and locker room doors saying that women and girls may be confronted there by men who think they are women.”

Although the commissioners passed a protection ordinance, a petition stopped it from becoming law. One report says the commissioners may just put it on the ballot and let voters decide.

While transphobic commentary by elected officials on transgender matters are rather commonplace, the comments made by Rep. McMillin is especially harmful since it put many trans people at a higher risk for abuse or assault who might not have been had McMillin kept his mouth shut.

Fear of “third gender” prompts some Swedish legislators to retain transgender sterilization law

EnochsonSKANBERG300THE GUERRILLA ANGEL REPORT — Never mind a recent Swedish court ruling stating the current practice of forced sterilization of transgender citizens was a violation of the European Convention on Human Rights, some legislators are arguing that the practice remain in place.

Fearing a “third gender,” Swedish Members of Parliament Tuve Skanberg and Annelie Enochson are opposing efforts in Parliament to enact legislation to delete the a requirement of sterilization for transitioning Swedish citizens.

It’s a bit early to tell if there is widespread support for this.

In an earlier report, I wrote about the United Nations’ position that forced sterilization was torture. While these two may consist of a minority of the Swedish Parliament, their actions are very Orwellianish and most certainly yet another blemish on an otherwise civilized country. Not too long ago, a man was cleared of raping a trans woman because the judge argued the victim wasn’t “technically” a woman. A higher court however, overruled that judge and found the rapist guilty. Arizona legislature to consider making it a crime for trans people to use “opposite sex” bathrooms without proper paperwork

THE GUERRILLA ANGEL REPORT — [Updated, see below.] This bit of news came from Brahm Resnik, a political writer from AZcentral.com in an article titled: Show me your papers’ — before you pee.

This is from the bill (SB 1432):

A PERSON COMMITS DISORDERLY CONDUCT IF THE PERSON INTENTIONALLY ENTERS A PUBLIC RESTROOM, BATHROOM, SHOWER, BATH, DRESSING ROOM OR LOCKER ROOM AND A SIGN INDICATES THAT THE ROOM IS FOR THE EXCLUSIVE USE OF PERSONS OF ONE SEX AND THE PERSON IS NOT LEGALLY CLASSIFIED ON THE PERSON’S BIRTH CERTIFICATE AS A MEMBER OF THAT SEX.

Resnik says that the bill is intended for transgender people, making it a crime for them to use a bathroom that doesn’t match the gender on their birth certificate. The hearing for this bill is scheduled 2 p.m. Wednesday (March 20th).

[UPDATED: March 20, 2013] The hearing has been postponed. This is from The Republic:

“The furor surrounding Phoenix’s new anti-discrimination law has found its way to the state Capitol, with opponents pushing a bill that would block many transgender people from using the public bathroom of their choosing. But in a surprise move, a scheduled hearing on the legislation was postponed Wednesday afternoon until sometime next week.

Rep. John Kavanagh, R-Fountain Hills, wants to create Arizona’s first law governing restroom privileges. Under Senate Bill 1432, someone would be guilty of disorderly conduct if he or she uses a bathroom, locker room or dressing room that’s not designated for the sex listed on his or her birth certificate.

. . .

Kavanagh submitted the proposal as a “strike everything” amendment to an existing bill, meaning it strikes out all the original language and uses its shell to advance an entirely different proposal. Because it has an emergency clause, the law would go into effect immediately if the governor signs it.

SB 1432 would make it illegal to enter a bathroom if signage indicates it is exclusively for the opposite sex. Authorities could charge violators with a Class 1 misdemeanor, punishable by a $2,500 fine and up to six months in jail.”

THE GUERRILLA ANGEL REPORT — Time and time again, I find Think Progress‘ Zack Ford allying solidly with trans folks. I especially like the way he holds politicians accountable for their transphobic actions. While it is true he does write primarily about LGBT issues and states he is gay, however, if one didn’t know any better, you’d think he was transgender with his intensity sometimes. Either way, my hats off to you Mr. Ford.

Meanwhile, Ford takes issue with some Massachusetts legislators who he says are retaliating against trans people following the issuance of a new Department of Education anti-discrimination policy for trans students.

Here are some transphobic comments made by MA state legislators:

Rep. Colleen Garry: “An anatomical male in a locker room could make girls feel uncomfortable and vice versa. . . .”

Rep. Marc Lombardo: “It’s time we say enough to this radical social agenda promoted by the administration and use common sense to protect our children.”

THE GUERRILLA ANGEL REPORT — Both California and Nevada state legislatures are considering pro transgender bills — in the former, a trans student rights bill, and in the latter, trans protection legislation.

California Assemblyman Tom Ammiano introduced a bill that allows trans students a right to use the restroom or locker room that corresponds with their gender identity. It also extends to sports — allowing trans students to play on teams corresponding with their gender identity.

The Transgender Law Center’s Masen Davis noted that this bill would make restroom or locker room use state law, as opposed to a policy — a method used by other states.

In Nevada, state Sen. Pat Spearman’s bill adds gender identity to the list of hate crimes in that state — Spearman hopes the bill’s severe penalties for hate crimes classification reduces violence against trans people.

Stripped from the House VAWA bill by Republicans was language to specifically include trans women and lesbians. The Senate has already passed a VAWA bill that includes both groups of people — a bill that got support from both sides of the aisle. Democrat leaders have denounced the actions of the House Republicans for making this anti-violence act a partisan issue.

The VAWA first became law in 1994, however, it needs to be reauthorized and House Republicans are derailing the reauthorization of bill after it was modified to include gender identity and sexual orientation. If the House version passes, it appears likely the transgender inclusion in the Senate bill will become a topic of prominence in Congress.

After a lengthy, two year battle, the Violence Against Women Act has been reauthorized by Congress after today’s vote in the House of Representatives. First enacted in 1994, the law was drafted to provide greater legal protections, services and other benefits (such as emergency housing) to survivors of domestic violence. Last April, the bill was modified by the Senate in order to address issues such as sexual orientation, gender identity, Native American reservations and undocumented immigration status. Although lesbian, bisexual, transgender, transsexual, Native American and undocumented women would have been explicitly protected under the law, the bill was rejected by Republicans in the House of Representatives for being “politically driven,” allowing the law to expire for the first time.

Since then, Republicans and Democrats in the Senate and in the House have battled over the additional protections given to minority groups. House Republicans drafted their own version of the Violence Against Women Act, stripping it of all provisions to include sexual orientation, gender identity, Native American reservations and undocumented immigration status. However, in a 286 to 138 vote, the House has passed the Senate’s all-inclusive version of the bill, after rejecting its own stripped down version by 257 to 166. President Obama is expected to sign the bill into law by the end of the week.

On heels of DC pro-trans PR campaign, city proposes easier ID change

THE GUERRILLA ANGEL REPORT — An affidavit from a doctor is all a transgender resident of Washington DC will need to get new birth certificate with the correct gender according to a new bill recently submitted to the DC city council.

Sponsored by city councilor David A. Catania and supported by a majority of other city councilors, it appears likely to get approved when it comes up for a vote at a later date.

This action follows an earlier advertising campaign by DC’s Human Rights Office promoting awareness of transgender residents of the city. This was done to ease some of the friction trans residents of the city had with the city over hate crimes, murders and a general unconcern city departments seemed to to have for them.

Superbowl linebacker hints at support of Maryland transgender rights bill

THE GUERRILLA ANGEL REPORT: Baltimore Ravens linebacker Brendon Ayanbadejo on transgender right: “. . . Let’s just treat everyone equally. Let’s move on. Let’s evolve as a culture, as a people.”

After winning the Superbowl, Ayanbadejo didn’t head to Disneyland, he instead went on CNN to talk about his LGBT rights advocacy. Last year he vocally supported the Maryland same sex marriage bill which is now law and he commented further on his support for it.

A trans rights bill has been proposed in the Maryland Assembly and Ayanbadejo’s comments apparently was in response to that.

The NFL isn’t exactly an entity where these things are openly discussed, so that door is open a bit wider now thanks to Ayanbadejo and other players more concerned with their fellow citizens than just themselves.

Same-sex marriage success in Maryland triggers transgender rights bill

THE GUERRILLA ANGEL REPORT — Democrats in the Maryland Senate last week introduced a transgender rights bill. While there’s ways to go before, or if, it becomes law, sponsors believe the acceptance of the same-sex marriage bill indicates there is a high probability of success this time around.

State Sens. Richard Madaleno and Jamie Raskin say  Senate Bill 449, the Fairness for All Marylanders Act of 2013 will close the gap for trans residents not living the Maryland cities and counties covered by an existing trans rights bill. Madaleno attempted to get a trans rights bill passed into law two previous times.

Prominent psychiatry expert: ‘no such thing as transgender’

THE GUERRILLA ANGEL REPORT — A Toronto psychiatrist, Dr. Joseph Berger, is saying that trans people working for equal civil rights are just appealing to people’s emotions rather than stating scientific facts.

Berger says that terms such as terms such as “gender expression” and “gender identity” are ambiguous and without basis in science. He says trans-identifying people are ‘psychotic or simply unhappy’ and surgery isn’t an appropriate treatment.

Berger: “The medical treatment of delusions, psychosis or emotional happiness is not surgery. . . . . I have read the brief put forward by those advocating special rights, and I find nothing of scientific value in it. . . .”

Berger has been making these comments in an apparent opposition to a Canadian federal bill (C-279) that would offer protection to trans people.

No doubt there is going to be a firestorm over this. I for one, think that if an “expert” doesn’t know that “transgendered” isn’t a word (which he repeatedly uses to refer to us) then he perhaps may not be qualified to speak on the topic.

Angry legislator proposes bill to pay for all sex reassignment surgeries to ‘make a point’

THE GUERRILLA ANGEL REPORT — Don’t be mislead — this legislator isn’t on the side of trans people — he’s toying around with us. Massachusetts state Rep. James Lyons, a Republican, is proposing this bill out of anger in reaction to a federal judge awarding legal fees to transgender convict Michelle Kosilek’s attorneys.

As you may recall, U.S. District Judge Mark Wolf ruled that denying Kosilek sex reassignment surgery (SRS) amounted to cruel and unusual punishment and ordered that the surgery be performed. He later ordered the state pay Kosilek’s attorney fees.

Rep. Lyons said he is trying to make a ‘profound point’ of his disagreement with the judge’s decisions by the introducing of a bill to pay the expense of SRS for all transgender people in the state. He wouldn’t say if he thinks it’ll pass.

Lyons: “The hard working citizens who follow the rules and pay their taxes do not qualify for benefits like this. If we provide extravagant benefits like this to a vicious murderer, then why deny them to the law abiding citizenry? . . .”

Stopping cruel and unusual punishment is not an extravagant expense.

Rep. Lyons is playing a dangerous game here. He’s using transgender people as pawns. Many trans people already live under dire circumstances — both physically and mentally. Toying trans people around like this is cruel. There should be consequences for Rep. Lyon’s reckless behavior.

THE GUERRILLA ANGEL REPORT — Thought we’d heard the last of Stacie Laughton, didn’t we? To refresh, she came to fame as the first transgender state representative elected to the New Hampshire legislature in November.

However, shortly after the election, it was discovered that she had a felony conviction on her record and there was question about whether she should have disclosed it or not. In the ruckus that ensued, she decided to resign only to later change her mind and announce she was keeping her seat after all. Shortly after that she changed her mind for a third time, and this time signed the resignation papers in front of a local television audience. End of story, or so we thought.

Now, word is Laughton is going to run for the vacant position in the special election set up to replace her. She says it’s what her friends, supporters and family want her to.

Politically, I’m thinking, why not? If she wins the seat again, the felony conviction would be completely behind her and maybe she’d be able to help improve the lives of trans people. But while I’m thinking about this, I’m looking at the photo of Laughton in the article, then I take a closer look at the photo — she’s ringing a bell for the Salvation Army!

No, she doesn’t have a clue. I encourage Nashua residents in the 4th ward to vote for a Democrat with a grasp of the issues that matter to trans/LGBT people, even if that candidate is not transgender.

Helena, Montana pushing for pro-trans/LGBT ordinance but includes odd trans “nude” restrictions

THE GUERRILLA ANGEL REPORT — The Helena, Montana, city commission is on the right track with a trans/LGBT anti-discrimination ordinance. The first vote  taken on it passed unanimously. However, to get to that point, an amendment was added that restricts certain trans people’s access to some facilities when nude.

The restriction: “In any place of public accommodation where users ordinarily appear in the nude, users may be required to use the facility designated for their anatomical sex, regardless of their gender identity.”

Not all commissioners are on board with the amendment however. Commissioner Katherine Haque-Hausrath says it is a violation of privacy but voted for the ordinance as amended. A final hearing and a vote on the ordinance is scheduled for December 17, 2012.

I am hoping that between now and the 17th, the city gets input from transgender legal advocates and do something about that amendment. For one thing, in the case of some trans people, their “anatomical sex” consists of both genders. Amendments ought not be proposed by people without a bit of background inquiry into the subject.

Trans anti-discrimination: Australia proposes national law; Syracuse, NY passes law

THE GUERRILLA ANGEL REPORT — In Australia this week, new national gender diversity legislation was proposed to fix inconsistent existing laws. By unifying all state and territory laws into one national law, trans and LGBT Australians will have the strongest anti-discrimination protection to date.

Anna Brown of the Victorian Gay and Lesbian Rights Lobby: “For the first time, a national law will outlaw discrimination on the basis of sexual orientation and gender identity, protecting our fundamental right to be free from discrimination and harassment. . . . The city of  Syracuse, NY this week passed a law that prohibits discrimination based on one’s “actual or perceived sex, or their gender identity or expression.” This law amends an existing 1990 anti-discrimination law that excludes transgender people. The new law prohibits discrimination in, among other things, housing, employment, and public accommodations.

Mayor Stephanie Miner: “It is an honor to serve as mayor of a city that has such a commitment to diversity and protecting our transgender brothers and sisters. This legislation will continue our longstanding efforts to ensure all Syracusans are able to live and work in a safe environment and send the message that we are a community which cares and will not tolerate discrimination.”
