Trans man working as cop forced to continue using women’s bullet proof vest

THE GUERRILLA ANGEL REPORT — Former city employee Marion Gregory Green is suing the city of Cayce, South Carolina for civil rights discrimination after work conditions changed for him following transition.

While it is not entirely clear if his demotion and eventual firing is a direct result of transitioning, but does appear a number of Green’s claims are valid, including his supervisors apparent denial of a male’s bullet proof vest following transition.

The suit was filed at the Lexington County Court in Cayce, SC. Green also worked in the fire department and in animal control during his 5 year career with the city.

While specific details in this case are lacking, the denial of proper safety-related gear is a bit of an eye opener.

Inmate threatens suicide in a legal motion to force gender reassignment surgery

THE GUERRILLA ANGEL REPORT — Oklahoma inmate and trans woman Ronny Darnell alluded to a suicide in a recent court motion that could result if her surgery isn’t granted in her pending federal case — this is an example of why one should never be their own attorney. Darnell needs allies in support of her case however, she may have lost a number of supporter with this dubious legal maneuver.

Suicide is a serious and widespread problem in the trans community and is likely the root of many legal actions taken by trans people. However, a compelling case must be built up with documented evidence supporting the suicide risk. Just saying there’s going to be a suicide as a legal maneuver amounts to blackmail — even if the threat ultimately turns into action. The legal system cannot be held hostage by a suicide threat.

Ms. Darnell has recently asked a judge for an attorney and I sincerely hopes that she lets that attorney handles things from here on out. Neither Darnell, the trans community, nor the legal system will benefit from the negative PR from this. I’m hoping this incident blows over quietly.

A South Korean court ruling makes it easy to change gender ID in this otherwise trans-unfriendly country

THE GUERRILLA ANGEL REPORT — While obviously this South Korean district court ruling allowing gender ID changes on documents without first having to undergo gender reassignment surgery is a huge positive step making them one of the few countries that permits this, however, South Korea is one of the last places I expected this to happen.

Last fall I reported on the cancellation of a trans-themed TV program that revealed the conservative nature of a large percentage of the South Korean population:

“While there is no way to know if the cancelled talk show “XY That Girl” was compelling television or mere exploitation, what I have learned is the South Korean people are largely social conservatives yielding enough clout to force the TV station, KBS Joy, to quickly yank the show.

It was thought that acceptance had finally gained a foothold in this country where LGBT people were long considered a ‘foreign phenomenon’, but it apparently is still not the case. Very few openly LGBT South Korean celebrities exist — and their lives are marred by blacklisting and other forms of oppression.  Transgender and LGBT people living there live mostly underground — something that harks back to the ’50s in the United States.”

The Gay Star News report of the court ruling doesn’t state if the documents includes birth certificates, nor do we know if the state is going to appeal this decision. Regardless, this may be a sign South Korea may be a country set on a path to becoming more in tune with other countries where the transgender and LGBT populations live in the 21st century.

Judge fines private Ohio club for discriminating against transitioning worker

THE GUERRILLA ANGEL REPORT — In what appears to be a final court settlement with owners of the private Columbus, Ohio, club Capital Club, a judge ordered the owners to pay a $1,000 fine for discriminating against a transgender employee. The case also happens to be Columbus’ first transgender discrimination claim.

Trans woman Savanna DeLong, previously a massage therapist at the club, filed a claim after the club quit using her when she announced she was transitioning. [Update: March 13, 2013 According to a different source, it was the city of Columbus that took action against the club, not DeLong herself. See the comments section below.] DeLong said that her intent wasn’t to ‘bring the company down’ but rather to educate. She is pleased with the outcome.

The owners pleaded no contest to the charges and a general manager agreed to diversity training.

Prosecutor Lara Baker-Morrish: “I feel that the Capital Club has taken responsibility, and I think that’s good.”

Trans woman ordered out of court house restroom by sheriff deputy wins legal ruling

THE GUERRILLA ANGEL REPORT — Trans woman Jodie Jones told Deputy Susan Henderson who had followed Jones into the women’s restroom at a court house, that she had a right to be there. Henderson, however, supposedly said “regardless of what the law is” she wasn’t going to let Jones use the restroom and ordered her out. Jones complied, but later filed a civil rights complaint.

Last week, Iowa Administrative Law Judge Heather Palmer ruled that the incident in the Johnson County Courthouse restroom had enough evidence to support Jones’ charges. Among some of the evidence was Deputy Henderson prior knowledge that Jones was transgender. Henderson’s statements were also found to be discriminative as well.

Along with support for Jones from the Iowa Civil Rights Commission, it is expected the parties involved will come to a settlement. As for Jones, she says she is doing this so others don’t have to endure the humiliation that happened to her. She says if the sheriff department apologizes, she won’t file a lawsuit. Deputy Henderson, however, has since retired.

This is a good outcome. I believe the deputy overstepped her bounds and tried to use Jones’ prior arrest history as justification for her actions, when in fact, one’s prior criminal history does not rid one of equality rights unless specified in bail or probation conditions. Jones, apparently, had no such conditions set.

Disturbing UK gender ID “fraud” sexual intimacy case complicated by age misrepresentation

THE GUERRILLA ANGEL REPORT — A Scottish trans man faces jail time after admitting to  ‘obtaining sexual intimacy by fraud’. Chris Wilson supposedly ‘did not tell his girlfriends he was trans’ before getting intimate with them and misrepresented his age, telling them he was 17 when he was actually was much older. Complicating the matter further is the possibility one of the girls wasn’t truthful about her age either. Either way, he is now on the sex offenders’ register and may be jailed.

The Scottish Transgender Alliance’s Nathan Gale told the Gay Star News: ‘We are very concerned for trans people because it could set a precedent forcing them to reveal their gender history to new sexual partners.’

Transgender activist Jane Fae, also speaking to Gay Star News, said her previous conversations with the prosecution (Crown Prosecution Service) following an earlier case somewhat similar to this one has her concerned that ‘in practice any trans man or trans woman who keeps their gender identity to themselves runs the risk of being charged’.

Clearly, there should never be a law where a trans person is required to reveal to their sexual partner their gender ID history. This case, however, is complicated with age misrepresentation — people may or may not have been of legal age to have an intimate relationship and this ought to be the primary focus here.  I do agree with Ms. Fae who has stated that an incident like this is a ‘time bomb waiting to explode.’

Australian judge says adverse consequences for trans child likely, rules for puberty blocking drugs

THE GUERRILLA ANGEL REPORT — A twelve-year-old transgender girl who has received mental health care for a decade and has identified as female for 6 years, will be allowed to be given puberty blockers following a ruling by the Family Court of Australia.

According to a report in an Australian newspaper, “Jodie” is at risk for ‘self harm’ which likely prompted the judge to make this ruling. Jodie will be the 4th youngest Australian to be given the drug.

Justice Christine Dawe: ” . . . evidence is compelling and clearly indicates that the child is likely to suffer significant, detrimental, psychological and emotional effects” if stage 1 treatment is not commenced.”

The ruling, however, does not allow a “stage 2″ oestrogen treatment. That decision awaits a ruling on another similar case currently under appeal in the Australian court system.

While I’m not entirely familiar with how one goes about getting puberty blocking treatment approval in Australia, it is apparent that doctors, child welfare specialists and now, the court system there have recognized the tragic consequences of denying a trans child this treatment. This helps makes the case stronger elsewhere in the world where puberty blockers are still considered inhumane, or worse.

DC judge slams suspect, DA on transgender attack case

Washington D.C. Superior Court Judge Rhonda Reid Winston, apparently fed up with the behavior of the accused attacker of an unnamed trans woman and the DA’s apparent withholding of evidence, laid down the law on both of them.

Winston ordered Ahmad Robinson, accused in August on an attack on a DC trans woman and apparently out of jail awaiting trial, to comply with the release terms. Robinson has a history of not following release conditions and this reprimand may be his final chance to avoid even harsher terms.

Winston also told the government be more forthcoming with evidence in the discovery phase with the defense team and to get it done by March 6th. The DA has already succeeded in getting a postponement of the trial and it is now scheduled for March 27.

The victim spotted and positively ID’d Robinson an hour after reporting the assault to the DC police.

This case has some in the DC trans community angry that Robinson was released from jail in the first place, and even more so now after he failed to comply with many of the conditions set for his release. The delay with release of evidence has some wondering about the strength of the case against Robinson.

Lawsuit prompts state of Oregon to provide sex reassignment surgery insurance coverage for state employees

THE GUERRILLA ANGEL REPORT — An out-of-court settlement to a discrimination lawsuit filed by a transgender Oregon Court of Appeals clerk has resulted in sex reassignment surgery insurance coverage for all state employees.  In addition, the state will pay Alec Esquival $36,000.

Esquival, a trans man, filed the lawsuit against the state and public employees benefits board after he was denied a doctor-recommended hysterectomy. Although a hysterectomy is a covered benefit, he was denied coverage because it was for the purpose of transitioning.

Esquival’s attorney Tara Borelli (of Lambda Legal): “When the state refused to provide him with coverage for the same medical procedure that co-workers could access, Alec was compensated less based on his gender identity. Oregon has now corrected that inequity.”

Oddly enough, a 2007 state law bans private insurance companies from gender or sexuality discrimination, seemingly allowing the public employees benefits board a loophole of some sort. With the settlement, that ambiguity is gone.

Federal appeals court orders Virginia trans inmate’s sex reassignment surgery lawsuit to proceed

THE GUERRILLA ANGEL REPORT — The 4th U.S. Circuit Court of Appeals unanimously reinstated a lawsuit that was previously tossed out by a lower court, which will now allows trans inmate Ophelia Azriel De’lonta to proceed with her case against the state of Virginia to allow her to undergo sex reassignment surgery.

De’lonta attorneys argued that to deny her the surgery amounted to “cruel and unusual” punishment — a violation of the Eighth Amendment. The court did not order the surgery but ruled the case was viable and the previous judge was wrong for tossing it. The case now goes back down to district court for further proceedings. De’lonta is in prison for bank robbery with a 73 year term.

4th Circuit Judge Albert Diaz: “The disease is “characterized by a feeling of being trapped in a body of the wrong gender . . . In these cases, the surgery is not considered experimental or cosmetic; is it an accepted, medically indicated treatment.”

Judge tells state of Mass. to report on trans inmate sex reassignment surgery prep status

THE GUERRILLA ANGEL REPORT — U.S. District Court Judge Mark L. Wolf, concerned that the state of Massachusetts is dragging its heels, stepped up enforcement of his order to prep for the sex reassignment surgery (SRS) of trans inmate Michelle Kosilek.

As you may recall, Judge Wolf earlier ruled that withholding SRS for Kosilek amounted to cruel and unusual punishment. According to a brief news report in the Boston Herald and the Mansfield Patch, last week, Judge Wolf ordered the corrections chief to submit a monthly report signed under oath on the status of the preparations. Judge Wolf has apparently put the actual surgery on hold while the state appeals its case, but wants the preparations completed.

It appears that if the higher court upholds his ruling, Judge Wolf wants the surgery to go forward shortly there after.

D.C. cop who fired at trans people in car while standing on hood sentenced to time served

THE GUERRILLA ANGEL REPORT — I’ve been following this story since the incident first occurred. Kenneth Furr, a Washington DC police officer who was convicted of assault last October in a bizarre incident which found him standing on the hood of a car firing though the windshield at the trans occupants of the car, was recently sentenced.

D.C. Superior Court Judge Russell Canan sentenced Furr to time served, but he does face a number of probation conditions and is currently out of jail. Furr has apparently been suspended for a while now, and the DC police say there is a process for firing cops with felonies, but didn’t comment further.

My previous comments that he was no longer a DC cop may have been premature. Apparently Furr was just suspended from the force pending a final court decision.

I’m not so sure much justice was served here, but on the other hand no one was killed and we have a convicted cop from an area where trans people have been getting the short end of the justice stick.

Forced sterilization of trans patients following sex reassignment surgery ends in Sweden

THE GUERRILLA ANGEL REPORT — It’s hard to imagine this kind of law was still on the books in such an educated European country, but nonetheless, the practice of sterilization ended this week after a Swedish court of appeal ruled the 1972 law was unconstitutional in December. They also said the forced sterilization violated the European Convention on Human Rights.

The Swedish parliament recently passed legislation to ban the practice, but it wasn’t scheduled to begin until later this year.

LGBT advocates in Sweden are hoping that parliament will compensate those who were sterilized. They are threatening a lawsuit if this doesn’t happen. There is a precedent for this – sterilized patients of Swedish a eugenics program were compensated when the practice ended in the  late 1990s.

Bail hearing for murderer of BC trans woman Jan. 7; Awareness rally planned for Jan. 5.

THE GUERRILLA ANGEL REPORT — The accused murderer of New Westminster trans woman January Marie Lapuz has a bail hearing Monday Jan. 7th according to the Canadian LGBT publication Xtra!

A news search resulted in no additional information about the accused, Charles Jameson “Jamie” Mungo Neel, since I wrote of his arrest earlier in December. However, in both the Xtra! article and on social media, there were concerns of the possible release of Neel during the hearing. However, as far as I can tell, these concerns were not based on recent developments, perhaps from the DA or the police, but rather, trans advocates’ stance of ‘categoric opposition to bail for accused murderers of trans people.’

That latter point was made by Leada Stray, one of the organizers of a rally to be held on Lapuz’s behalf two days before the hearing. Strays says they’re not asking people to pass judgement before Neel gets a fair trial, but rather, drive home the message that trans people are not safe in a country supposedly known for its pro-LGBT stance and leadership.

Transgender inmate’s lawyers to get $700K in ‘denying SRS is cruel and unusual punishment’ case

THE GUERRILLA ANGEL REPORT — No doubt mainstream media is going to exploit this decision by the federal judge who earlier ruled favorably on transgender inmate Michelle Kosilek’s request for SRS, into a barrage of attacks against trans people, so I might as well get ahead of this and state the facts.

If you recall, Federal Judge Mark Wolf, in a landmark decision last September, ordered the state of Massachusetts to provide SRS for Kosilek because the judge decided that withholding the surgery in Kosilek’s case amounted to cruel and unusual punishment. What the judge did not say was that all trans inmates can get SRS at the state’s expense on demand. He based his decision on the fact Kosilek endured 9 years of medical treatment before reaching the point that SRS was “only adequate treatment” left. Other prisoners would likely need to follow the same course of treatment before SRS is considered.

Being awarded legal fees is only the natural course of action here. Any prisoner found suffering from cruel and unusual punishment at the hands of the state is entitled for legal fees reimbursement. Such large payments have been awarded before. This should be no surprise to anyone.

The state of Massachusetts is trying to appeal Wolf’s decision, however, the judge said Kosilek’s team would forgo the fees if the state drops their appeal. The state had no comment.
