THE GUERRILLA ANGEL REPORT — The accused murderer of New Westminster trans woman January Marie Lapuz has a bail hearing Monday Jan. 7th according to the Canadian LGBT publication Xtra!

A news search resulted in no additional information about the accused, Charles Jameson “Jamie” Mungo Neel, since I wrote of his arrest earlier in December. However, in both the Xtra! article and on social media, there were concerns of the possible release of Neel during the hearing. However, as far as I can tell, these concerns were not based on recent developments, perhaps from the DA or the police, but rather, trans advocates’ stance of ‘categoric opposition to bail for accused murderers of trans people.’

That latter point was made by Leada Stray, one of the organizers of a rally to be held on Lapuz’s behalf two days before the hearing. Strays says they’re not asking people to pass judgement before Neel gets a fair trial, but rather, drive home the message that trans people are not safe in a country supposedly known for its pro-LGBT stance and leadership.

New Westminster Councillor Jaimie McEvoy is among the people planning to attend the rally: “I think it’s important when you have a group of people in society — who as a group are among the most disadvantaged in Greater Vancouver — I think it’s important for anybody to show their support.”

Tragic oppression of transgender people in Kuwait continues

THE GUERRILLA ANGEL REPORT — The latest — A young trans woman and her mother were arrested after the police decided that a young woman in a car was a ‘boy in women’s clothing’.

I’ve been tracking these arrests and Gay Star News is reporting there are now 16 trans women in jail in Kuwait.

This morality campaign, partially triggered by the Arab Spring, targets more than just trans people — LGB people are also being oppressed under a 2007 Islamic-backed law allowing the Kuwaiti government to curtail the rights of trans and LGBT citizens.

Kuwait isn’t just some third world country. They’re intelligent and wealthy. The United States spent hundreds of billion of dollars rescuing them in the first Gulf War. If the mid east explodes into war, the United States is likely to come to the aid of Kuwait again. We have the upper hand here and requiring that the Kuwaiti government knock off the arrests and torture of its trans and LGBT citizens ought to be a relatively easy task.

THE GUERRILLA ANGEL REPORT — (This was published in the Dec. 2012 issue of Just Out.) As trans people go about their lives, there’s the daily dilemma of where to pee? Aside from our homes, and perhaps workplace and social routines, “where to pee?” is the question trans people are most likely to ask ourselves when we’re out and about. Unfortunately, we usually just mumble in silence and look for the lesser evil of the choices we usually have — a male or female restroom — knowing that using one or the other could result in being shouted at or violently attacked.

Trans people have been physically harmed for using the seemingly safer female restroom as evidenced by a recent east coast attack on a transgender fast food customer that was captured on videotape and closed-circuit TV. This nationally reported incident resulted in lengthy jail terms for the two female attackers.

Gatekeepers can also get in the way of safe bathroom decisions. Across the river in Vancouver, a bartender denied a trans woman access to the women’s restroom, which later led to local media coverage. While television news cameras were rolling, the bartender explained she has no problems with trans customers, but drew the line at allowing the trans patron usage of the ladies’ room because the trans woman is “still a boy and she wants to go in the woman’s restroom…” Although the trans patron has since filed a complaint with that state’s human rights commission, it shows that trans people not only have to face difficulty with other users of public rest rooms, but also with those that own them.

Gender-neutral restrooms, of course, are the solution, and down the road there will be more of them as the paradigm of public restrooms changes as a result of transgender advocacy.

In Portland, a number of businesses and agencies are already on board with gender-neutral bathrooms. The Q Center, Reed College, PSU, SMYRC, and Portland Loos already have gender-neutral sites. A Portland business, Floyd’s Coffee Shop, adopted the idea after a customer suggested it.

A website — safe2pee.org — collects information about gender-neutral or trans-safe bathrooms around the country and makes it available to anyone at no cost. I found that Portland appears to be in the top five cities with reported gender-neutral bathroom sites. I spotted numerous Portland businesses, retailers, malls and movie theaters in the database. Browsing through the Portland locations listed will bring peace of mind to many trans people in the city.

In addition, there is an app for the iPhone that taps into the safe2pee data. By utilizing GPS, the TranSquat app can bring up the gender-neutral locations closest to you. It’s community driven so that users can add or update the database. Those new to Portland, or on the go in another city, can use this app to make safe choices. Trans man Billy Bolt developed the app to help fund his sex reassignment surgery — a really clever idea. There isn’t an Android version at this time, but I wouldn’t be surprised if one came out down the road.

To help make the where to pee(?) dilemma a thing of the past, trans and the entirety of the LGBT community, as well as their allies can make a routine habit of urging places and businesses they frequent to adopt gender-neutral bathroom policies. Not only might some businesses like to be ahead of the curve on providing this access if given information of the need, others could be persuaded of the financial sense it makes when shown the safe2pee database, especially if their location is likely to be suggested to potential customers using the TranSquat app.

Transgender fashion/art magazine does homage to Michelle Obama

THE GUERRILLA ANGEL REPORT — There’s no doubt this photo shoot for Candy magazine will trigger heated debates in a number of different venues.  But that is part of what art is — pushing and exploring boundaries. I, for one, am glad to see this sort of homage to our First Lady presented this way.

I don’t know what Michelle Obama thinks of this, however as a public figure, it technically doesn’t matter. That aside, I do think she’s okay with being part of the awareness transgender people in this manner.

The magazine publisher, Luis Venegas, says they’re a transgender/androgyny “style magazine about fashion, art, culture, make-up, glamour, icons, amazing transformations and fun.”

For the magazine’s fifth issue, trans model Connie Fleming portrays Michelle on the cover. Earlier Candy issues featured Andrej Pejic, James Franco, and Chloe Sevigny in drag. I’m curious who will be featured next.

BTW, I noticed there is more than one “Candy” magazine — another appears to be a teen magazine, so for those of you headed to Google, be advised, lest you get confused!

Miss Universe pageant generates loads of positive PR for trans people in 2012

THE GUERRILLA ANGEL REPORT — Transgender people went 3 for 3 in the positive PR department on the Miss Universe beauty pageant circuit in 2012.

Earlier this year Canadian trans woman Jenna Talackova pioneered the acceptance of transgender contestants in that pageant and last week, a cis-contestant who previously voiced her support of transgender participation back in June, Olivia Culpo, was crowned Miss Universe.

Here’s what Culpo, then Miss Rhode Island, said during the Miss USA pageant in response to this question: Would it be fair if a transgender woman won the Miss USA title?:  “I do think it would be fair…  there are so many people who have a need to change for a happier life. I do accept that because I believe it’s a free country.”

Culpo, a Boston University sophomore, went on to win the Miss USA title in June and the Miss Universe title last week.

Contrast that from what Carrie Prejean, Miss California (2009) USA, said back in the 2009 pageant: “I believe that marriage should be between a man and a woman, no offense to anybody out there. But that’s how I was raised and I believe that it should be between a man and a woman.”

Also. there’s this third positive bit of news from the Miss Universe pageant that ought to bring a smile to many trans people’s faces. Last week, the Miss Universe organization won a lawsuit against Sheena Monnin, former Miss Pennsylvania USA, who quit in the middle of the pageant, for, among other things, allowing transgender contestants.

This statement was reportedly sent by Monnin to the pageant officials: “I refuse to be part of a pageant system that has so far and so completely removed itself from its foundational principles as to allow and support natural born males to compete in it. This goes against ever (sic) moral fiber of my being.”

I’m not so sure if they’ll be able to collect the $5 million they’re asking for, but I like the idea that hate can be expensive.

An unexpected twist in the saga of resigned transgender NH State Rep.-elect Stacie Laughton

THE GUERRILLA ANGEL REPORT — Thought we’d heard the last of Stacie Laughton, didn’t we? To refresh, she came to fame as the first transgender state representative elected to the New Hampshire legislature in November.

However, shortly after the election, it was discovered that she had a felony conviction on her record and there was question about whether she should have disclosed it or not. In the ruckus that ensued, she decided to resign only to later change her mind and announce she was keeping her seat after all. Shortly after that she changed her mind for a third time, and this time signed the resignation papers in front of a local television audience. End of story, or so we thought.

Now, word is Laughton is going to run for the vacant position in the special election set up to replace her. She says it’s what her friends, supporters and family want her to.

Politically, I’m thinking, why not? If she wins the seat again, the felony conviction would be completely behind her and maybe she’d be able to help improve the lives of trans people. But while I’m thinking about this, I’m looking at the photo of Laughton in the article, then I take a closer look at the photo — she’s ringing a bell for the Salvation Army!

No, she doesn’t have a clue. I encourage Nashua residents in the 4th ward to vote for a Democrat with a grasp of the issues that matter to trans/LGBT people, even if that candidate is not transgender.

Transgender inmate’s lawyers to get $700K in ‘denying SRS is cruel and unusual punishment’ case

THE GUERRILLA ANGEL REPORT — No doubt mainstream media is going to exploit this decision by the federal judge who earlier ruled favorably on transgender inmate Michelle Kosilek’s request for SRS, into a barrage of attacks against trans people, so I might as well get ahead of this and state the facts.

If you recall, Federal Judge Mark Wolf, in a landmark decision last September, ordered the state of Massachusetts to provide SRS for Kosilek because the judge decided that withholding the surgery in Kosilek’s case amounted to cruel and unusual punishment. What the judge did not say was that all trans inmates can get SRS at the state’s expense on demand. He based his decision on the fact Kosilek endured 9 years of medical treatment before reaching the point that SRS was “only adequate treatment” left. Other prisoners would likely need to follow the same course of treatment before SRS is considered.

Being awarded legal fees is only the natural course of action here. Any prisoner found suffering from cruel and unusual punishment at the hands of the state is entitled for legal fees reimbursement. Such large payments have been awarded before. This should be no surprise to anyone.

The state of Massachusetts is trying to appeal Wolf’s decision, however, the judge said Kosilek’s team would forgo the fees if the state drops their appeal. The state had no comment.

Tony Perkin’s transgender/LGBT-hate group drops UPS as “official shipper!”

perkinsupsx300THE GUERRILLA ANGEL REPORT — As payback for UPS dropping their financial support of the Boy Scouts, the hate group Family Research Council (FRC) said UPS will no longer be the FRC’s “official shipper.” This is according Tony Perkins, president of that organization in a statement reported by CNN.

The fallout from FRC’s decision is likely to not register one iota either on the Richer Scale or UPS’ Cash Register.

If Mr. Perkins is a man of his word, he pretty much has to drop Intel as their “official computer chip”. In the dumpster behind the FRC headquarters I expected to find it filled of PCs purged from the building. Merck (FRC’s “official drug”), however, presents a dilemma — the hepatitis vaccine isn’t easily removed from one’s body.

Now all this would be pretty funny if it weren’t for the real harm Perkins and his hate organization inflicts on transgender/LGBT Americans. Mr. Perkins often equates LGBT with pedophiles as a PR ploy to keep us from obtaining equal rights. The prominent civil rights organization Southern Poverty Law Center considers FRC as a hate group.

Spineless Illinois school board votes to yield to mob on transgender policy

THE GUERRILLA ANGEL REPORT — Well, we’ve seen it all now. For those of you following the East Aurora School Board comedy of errors, be advised that the board decided that an angry mob that interrupted their Ad Hoc committee assigned with coming up with a transgender policy for kids, spoke for the entire community. This mob was so convincing that the board voted unanimously to disbanded the Ad Hoc committee and take a trans policy completely off the table. The victory here goes to anti-transgender hate group the Illinois Family Institute.

At this point I don’t know which group is the lessor evil — a widely recognized hate group or a school board scared stiff of them.

The Civil Rights Agenda’ Anthony Martinez, “I think it was a failure of leadership by the school board. I think the folks handling this from the beginning were out of their depth. You only have to look and see that the Ad Hoc committee never once discussed the matter of policy. All we did was sit and listen to people voice their displeasure.”

Unless someone thinks there is a legal avenue to pursue, the burden is now on the citizens living in this district to bring in new board members more in tune with the 21st century.

Helena, Montana anti-trans discrimination ordinance passes, but . . .

helenaigougocom300THE GUERRILLA ANGEL REPORT — It appears the Helena City Commission unanimously passed their transgender/LGBT anti-discrimination ordinance. While the news reports I looked at didn’t specifically mention if this included gender identity, I checked NTCE’s Mara Keisling’s Facebook page for confirmation:

“VICTORY in Helena, Montana. By a vote of 5-0, Helena becomes the 2nd city in MT to offer anti-discrimination protections based on sexual orientation and gender identity.”

However, the “transgender nude restriction” apparently remains in place. This restriction supposedly addressed a concern about voyeurs and pedophiles. City commissioner Katherine Haque-Hausrath, again tried to fix this to the benefit of trans people, but her amendments failed.

I’m not so sure like being equated with “voyeurs and pedophiles” and I suppose it would take a lawsuit to clear this up. On the other hand, we’re talking Montana, an unlikely place for trans/LGBT protection ordinances. We’ll call it a “victory, but.” I also have a feeling there are going to be more of these “victory, but” ordinances which is why nipping this form of associating transgender with pedophiles need to done pronto!

Transgender travelers vs the Transportation Security Administration (TSA)

tsa290THE GUERRILLA ANGEL REPORT — There’s no doubt the TSA has been the ire of plane travelers in the United States, especially transgender ones. In the early days of the program, trans people were getting “outed” unintentionally (perhaps sometimes even deliberately). Then, contact with the TSA proved to be intrusive and embarrassing. Understandably, many choose not to fly for that reason alone.

The program has been around for a while now, so certainly some progress has been made, not just for trans people, but for the entire flying public. However, in a recent matter not directly related to the TSA, trans people still had harsh words for the TSA.  Here are a few juicy choices:

“The TSA is a joke.”

“I won’t fly as long as the TSA has the power they do. They are simply thugs”

This had me thinking about the TSA . . . are they really still as bad as trans passengers making them out to be? An answer came in the form of a comment made by a reader of my article who pointed out that the TSA is actually concerned about transgender passengers to the point that they have a specific web page for us: http://www.tsa.gov/traveler-information/transgender-travelers

Indeed, the very first thing you see is this:

“TSA recognizes the concerns members of the transgender community may have with undergoing the security screening process at our Nation’s airports and is committed to conducting screening in a dignified and respectful manner.”

The webpage contains travel tips and explains the screening process for trans people. But most importantly, I thought, was this section:

“Reporting Travel Issues or Concerns

Travelers who believe they have experienced unprofessional conduct at a security checkpoint are encouraged to request a supervisor at the checkpoint to discuss the matter immediately or to submit a concern to TSA’s Contact Center at: TSA-ContactCenter@dhs.gov.

Travelers who believe they have experienced discriminatory conduct because of a protected basis may file a concern with TSA’s Office of Civil Rights & Liberties, Ombudsman and Traveler Engagement. Travelers may also file discrimination concerns with the Department of Homeland Security (DHS) Office for Civil Rights and Civil Liberties.”

Yes, that’s correct, the TSA suggests you ask for a supervisor immediately at the checkpoint if there is a problem.

No, I’m not going to say the system is perfect, but I’m arguing headway has been made and means are available for transgender people to help improve the system.

I’m also suggesting that comments about the TSA on the internet may not reflect how things really are.

If you’re going to fly, I’d suggest printing out the webpage and carrying it with you. If you get a rogue agent, ask for a supervisor and show them the flyer.

[UPDATED] Trans woman killed in Istanbul street, suspect taken into custody

THE GUERRILLA ANGEL REPORT — [Update -- see below.] According to a Turkish news report translated into English, a trans woman was shot in the middle of the street in Istanbul, Turkey. She was shot in the chest and her body was taken for an autopsy according to the translation.

The police arrested a driver of a car on suspicion of murder. The police did not release the name of the person arrested but the report stated that the shooting might have been a dispute over money.

I’m not entirely sure if the article gave the victim’s name. The translation doesn’t make it clear enough for me to make note of it in this report. If anybody fluent in the language can read the report and post what you find in the comment section, we’d appreciate it.

As a side note, in the article’s comment section, I noticed that many of the comments are religious or trans hate- biased — the same as we often see in American media comments.

Another side note, this is the first trans death that I’m aware of since TDOR 2012.

Justice for trans woman’s rough airport experience becomes undone by lack of facts shared on social media

AirportTHE GUERRILLA ANGEL REPORT — This is a tough topic to tackle. What ought to be a no brainer decision for a reporter becomes a moral dilemma because the victim involved also had a hand in the spreading of misinformation on the internet.

Of course, anyone experiencing what appears at first glance to be mistreatment by law enforcement officers may make emotional and not entirely correct statements at first. However, even after the passage of time, the victim in this incident did not disclose facts nor correct errors in her follow-up posts on social media. Nor did she set the record completely straight during or after being interviewed by a LGBT publication. As a result, neither I or other trans advocates can make completely favorable comments on her behalf.

Fortunately for the victim, there was a recourse for her to report her mistreatment and she has stated she has done so. So hopefully this matter comes to a satisfactory conclusion for her.

I’m not using the victim’s name because this story is not about her personally, but rather, focused on the importance of stating only the facts. Simply put: if you don’t know, don’t guess! Us trans people do not need to create our own misinformation and spread it on the internet! We already have our hands full with the misinformation society has regarding us.

As an aside, there are times when one ought to speak to a lawyer before making any public statement, but in this case, the victim went ahead, and continued to make, public statements including talking to the media.

This is a summary of the events that unfolded. The story first broke on social media by a friend of the victim:

“. . . Monday, December 10th, 2012, my good friend [victim] was at [airport of a major U.S. city] on board her flight to [another major U.S. city] when the police boarded the aircraft, handcuffed and arrested her. They held her for a few hours telling her she had no rights and demanded why she was “Transgender”. . . .” (this story was shared on social media at least 50 times, likely in the hundreds.)

There was no mention of which airline, flight number and other key details. Nevertheless, over the next several days I searched the net for additional information, anything that would confirm this story, including the city’s police arrest database which listed people arrested at the airport. Her name was never on the list each time I checked it.

As we eventually found out, she was never arrested, nor did that city’s police officers board the aircraft or handcuffed her in the aircraft.

Later, the victim posted this on her social media page that began with [this post has since been deleted from her social media page and I thus cannot confirm the date]:

“Arrested in [city] . . .”

Again, this turned out to be a false statement, this time stated by the victim.

Meanwhile on social media, people shredded that city’s police department, the TSA, airport authorities — which ever law enforcement agency happened to be the favored target of that particular thread. Again, we did not know at the time which, if any, of these authorities “arrested” her.

Likewise, people unloaded on Delta, Southwest Airlines, a number of smaller regional carriers that partners with the major airlines. Which one was the actual airline, if any of these, at all? We don’t know. We still don’t know.

On Dec 12th, another post from the victim on her social media page:

“. . . . This is going to be an overwhelming day . . . contacting lawyers and commissions, the news media, and in general just keeping it all together. . . . This arrest in [city] . . .”

She again repeats her earlier false statement, but mentions she’ll be talking to the media, but does not mention which airline nor correct any of the misinformation being posted on social media.

On Dec. 13th, a story came out in a LGBT publication and this is the gist of the whole incident:

“Shortly after she boarded the plane, [victim] said a flight attendant walked her off the plane to a group of [city] police officers, who handcuffed her and detained her for public drunkenness for two hours.”

It was the, still unnamed, airline that removed her off plane. Not the city police, nor the TSA or airport authorities. She wasn’t handcuffed on the plane either.

Later in the article, there is a quote from a detective with the city police:

“If a pilot feels there’s a safety issue with a person on a plane, that person is removed. . . .”

Well, there you have it. Did the airline go overboard here? Perhaps. Did we go into a gossip feeding frenzy spreading misinformation on the internet? Certainly.

Illinois school board’s transgender policy flip-flop gets uglier and uglier

THE GUERRILLA ANGEL REPORT — I’ve sort of thrown in the towel on East Aurora School District’s attempt to create a transgender protection policy. If a school board can rescind a trans kids policy in a matter of days after adopting it in the face of pressure from religious extremists, then there’s no hope that this current board will be able adopt another one anytime soon — even if they appeased us by creating an Ad Hoc committee to come up with something. An election cycle or two needs to happen and hopefully new board members with backbone get seated.

At the most recent Ad Hoc committee meeting, with police presence ordered by the Department of Justice, the organized opposition to any transgender policy was so intense that the chairperson, Anita Lewis, declined to schedule further meetings over concerns of the safety of the committee’s members — some of whom are transgender. Pro transgender supporters were booed and shouted down according to one news report, and a transgender committee member felt intimidated — one man kept referring to her as “him”.

Ms. Lewis, who also serves on the school board, will be reporting her concerns to the board, placing the ball back in the school board’s hands — the same people who dropped the ball the first time around.

FBI reported hate crime data for 2011 released — transgender data collection to begin in 2013

THE GUERRILLA ANGEL REPORT — The FBI reported hate crime data came out and I jumped right in to see what was reported on the basis of gender identity. I was surprised to find out that the FBI does not collect data on gender identity hate crimes!

Perhaps I should have guessed this. We’re a decade or more behind the civil rights afforded our LGB brothers and sisters, so it does follow that we’re also behind in the collection of gender identity hate crime data.

There is some good news –  as a result of the 2009 Matthew Shepard and James Byrd, Jr., Hate Crimes Prevention Act, the FBI will begin to collect gender identity data in 2013 and report the findings in 2014. According to a Human Rights Campaign (HRC) press release, they had a hand in getting the FBI to start compiling the data on gender identity.

Meanwhile, the HRC’s interpretation of the data indicates LGB hate crimes reported to the FBI increased in 2011, surpassing hate crimes based on religion, and now ranks just below the most frequent hate crime, race.

You can look up the data on the FBI’s site. It is broken down by cities, metro areas and states for those of you curious about your area. LGB data only. It’ll be two years before trans people are in the know.
